The Submitter, by uploading musical content to MSK Media Group LLC, hereby represents and warrants that they are the sole and exclusive proprietor of all copyrights and intellectual property rights appurtenant thereto, or that they possess all requisite licenses and permissions to authorize the use and distribution of said content. Upon the expiration of the seven (7) day trial period or in the event of a failure to remit monthly subscription fees within a three (3) day grace period, all musical content uploaded during the trial or associated with the delinquent account, respectively, shall be removed from MSK Media Group LLC’s proprietary platforms, save for pre-existing placements on external media, including but not limited to broadcast television, radio, and third-party distribution channels. This removal shall be without prejudice to any other rights or remedies available to MSK Media Group LLC under applicable law or contract.

Each Submitter shall be entitled to participate in the 7-Day Music Accelerator Trial only on one occasion. Subsequent requests for the 7-Day Trial will be denied. In the event a Submitter terminates their subscription or does not enter into a paid subscription agreement following the completion of the 7-Day Trial, a mandatory waiting period of thirty (30) calendar days shall be imposed before any new musical content from said Submitter may be submitted for consideration or placement on the MSK Media Group LLC platform.

In the event that submitted material is determined to infringe upon the intellectual property rights of a third party, or if it is not duly registered with relevant performing rights organizations such as ASCAP or BMI, the Submitter hereby acknowledges and consents to MSK Media Group LLC’s right to acquire, upon forfeiture, complete ownership of the submitted musical composition, encompassing all rights, title, and interest in the master recording and associated musical works. This acquisition shall be a direct consequence of the Submitter’s breach of the representation and warranty concerning originality and proper registration. MSK Media Group LLC shall retain the unrestricted right to utilize said acquired material for promotional, commercial, and any other purposes, at its sole discretion, without further compensation or notification.

Furthermore, by uploading content to the platform, the Submitter irrevocably releases and holds harmless MSK Media Group LLC, its affiliates, employees, and agents from any and all claims, demands, liabilities, or causes of action, whether sounding in contract, tort, or otherwise, arising from the use, distribution, or reproduction of the Submitter’s musical works, or any alleged infringement thereof. The Submitter assumes full legal responsibility for any litigation or claims that may arise concerning the submitted material. The Submitter further acknowledges that Hot Vibez Radio, Soulful Vibez Radio, or any other subsidiary of MSK Media Group LLC, MSK Holding Company, or Trending Vibez Entertainment shall not be held liable or responsible for any musical content played on their respective stations. MSK Media Group LLC reserves the right to remove any song from its airwaves that it deems unfit for broadcast. In the event that MSK Media Group LLC acquires ownership of musical content due to forfeiture as a result of misrepresentation or infringement, the company reserves the right to pursue all available legal remedies, including but not limited to litigation, to protect its acquired intellectual property rights.

MSK Media Group LLC collects and utilizes user data in accordance with its Privacy Policy, accessible via [insert privacy policy link here]. User data may be used for analytics, service improvement, and marketing purposes. MSK Media Group LLC reserves the right to modify these Terms and Conditions at any time. • Forfeiture: Refers to the act of relinquishing ownership of musical content to MSK Media Group LLC due to a breach of the representations and warranties herein.

• Proprietary Platforms: Refers to all online and offline platforms owned or operated by MSK Media Group LLC, including websites, radio stations, and streaming services.

• Performing Rights Organizations (PROs): Refers to organizations such as ASCAP and BMI that collect and distribute royalties on behalf of copyright holders."
